{"id":30717,"date":"2023-05-07T06:00:00","date_gmt":"2023-05-07T05:00:00","guid":{"rendered":"https:\/\/omnesmag.com\/?p=30717"},"modified":"2023-05-04T10:24:51","modified_gmt":"2023-05-04T09:24:51","slug":"droits-fondamentaux-de-la-maternite-de-substitution","status":"publish","type":"post","link":"https:\/\/www.omnesmag.com\/fr\/firmas\/editorial\/gestacion-subrogada-derechos-fundamentales\/","title":{"rendered":"Gestation pour autrui : oublier les droits fondamentaux\u00a0"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><em>\"Toute d\u00e9cision, loi ou politique susceptible d'affecter les enfants doit tenir compte de ce qui est dans l'int\u00e9r\u00eat sup\u00e9rieur de l'enfant. <\/em>Il s'agit de l'un des droits fondamentaux, inscrit dans la <a href=\"https:\/\/www.unicef.es\/publicacion\/convencion-sobre-los-derechos-del-nino\">Convention relative aux droits de l'enfant<\/a> que des gouvernements du monde entier, des chefs religieux, des ONG et d'autres institutions ont sign\u00e9 le 20 novembre 1989, et qui sont aujourd'hui \u00e0 nouveau d'une grande actualit\u00e9. Le rappel de cette maxime n'est pas anodin face \u00e0 une question telle que la maternit\u00e9 de substitution, dont le d\u00e9bat est au premier plan du terrain socioculturel de l'Occident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans une soci\u00e9t\u00e9 marqu\u00e9e par le droit d'avoir des droits, le soi-disant droit \u00e0 la maternit\u00e9 \/ paternit\u00e9, dans des pratiques telles que la maternit\u00e9 de substitution, l'emporte sur les droits l\u00e9gitimes du mineur \"cr\u00e9\u00e9\" et sur les droits de la femme enceinte qui devient un simple instrument, <em>un \"ut\u00e9rus\" \u00e0 la disposition de la partie contractante, ouvrant la voie \u00e0 l'exploitation et \u00e0 la commercialisation de la personne humaine\".<\/em>Les \u00e9v\u00eaques espagnols ont soulign\u00e9 ce point dans une note sur la gestation pour autrui.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;De nombreux aspects juridiques, \u00e9thiques et m\u00e9dicaux sont en jeu dans ce processus de maternit\u00e9 de substitution : c'est ce que soulignent les nombreux experts de diff\u00e9rents domaines qui ont collabor\u00e9 au dossier qu'Omnes a produit sur cette pratique.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Des r\u00e9alit\u00e9s telles que celle abord\u00e9e dans ces pages soulignent la n\u00e9cessit\u00e9 d'une r\u00e9flexion transversale et engag\u00e9e qui favorise la r\u00e9cup\u00e9ration des principes \u00e9thiques et moraux sur lesquels se fonde une soci\u00e9t\u00e9 v\u00e9ritablement humaine, visant \u00e0 respecter et \u00e0 sauvegarder la dignit\u00e9 de chaque \u00eatre humain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Comme le rappelle le pape Fran\u00e7ois dans<em> <a href=\"https:\/\/www.omnesmag.com\/fr\/focus\/ecologie-integrale\/laudato-si-has-ete-une-ligne-divisive-pour-leglise-et-pour-le-monde\/\">Laudato Si'<\/a>Le bien commun pr\u00e9suppose le respect de la personne humaine en tant que telle, avec des droits fondamentaux et inali\u00e9nables ordonn\u00e9s \u00e0 son d\u00e9veloppement int\u00e9gral\".<\/em>. Mettre le progr\u00e8s technique et m\u00e9dical au service d'une pratique sous-tendue, \u00e0 l'extr\u00eame, par un capitalisme anti-humain qui transforme les \u00eatres humains en objets de transactions \u00e9conomiques ou affectives ne peut \u00eatre accept\u00e9 comme faisant partie du d\u00e9veloppement int\u00e9gral que les \u00c9tats et les citoyens doivent servir dans leurs t\u00e2ches sociales et communautaires.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il nous incombe \u00e0 tous d'\u0153uvrer pour ce bien commun, ce qui signifie <em>\"D'une part, prendre soin et, d'autre part, utiliser cet ensemble d'institutions qui structurent juridiquement, civilement, politiquement et culturellement la vie sociale, qui est ainsi configur\u00e9e comme une polis, comme une cit\u00e9. On aime d'autant mieux son prochain que l'on travaille \u00e0 un bien commun qui r\u00e9pond aussi \u00e0 ses besoins r\u00e9els\".<\/em> (<em>Caritas in veritate, 7<\/em>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a0Des initiatives telles que la D\u00e9claration de Casablanca, sign\u00e9e r\u00e9cemment dans la capitale marocaine, constituent, comme le soulignent les signataires eux-m\u00eames, un point de d\u00e9part pour recentrer le \"regard social\" sur la dignit\u00e9 inviolable de l'\u00eatre humain \u00e0 tous les stades de sa vie. <\/p>","protected":false},"excerpt":{"rendered":"<p>\u201cCualquier decisi\u00f3n, ley o pol\u00edtica que pueda afectar a la infancia tiene que tener en cuenta qu\u00e9 es lo mejor para el ni\u00f1o\u201d.
